How to get an injunction or restraining order for dating violence?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Restraining orders (known as injunctions) for protection against sexual violence are controlled by\u00a0\u00a7\u00a0784.046,\u00a0 Statutes.<\/a><\/p>\n

Under\u00a0\u00a7 784.046, Statutes<\/a>, you may qualify for an injunction or restraining order if you are the victim of \u201csexual violence\u201d.\u00a0 Florida law defines, \u201csexual violence\u201d as any incident of the following:<\/p>\n

    \n
  1. Sexual battery, as defined in chapter 794;<\/span><\/li>\n
  2. A lewd or lascivious act, as defined in chapter 800, committed upon or in the presence of a person younger than 16 years of age;<\/li>\n
  3. Luring or enticing a child, as described in chapter 787;<\/li>\n
  4. Sexual performance by a child, as described in chapter 827; or<\/li>\n
  5. Any other forcible felony wherein a sexual act is committed or attempted.<\/li>\n<\/ol>\n


    It is important to note that Florida law says, that you may still be entitled to an injunction based on sexual violence, regardless if any criminal charges based on the incident were filed, reduced, or dismissed by the state attorney. This means that any criminal case or investigation is totally independent from your right to obtain an injunction.<\/p>\n

    Florida law,\u00a0specifically \u00a7 794.011(1)(h)<\/a>, Statutes, defines \u201csexual battery\u201d as \u00a0the \u201coral, anal, or vaginal penetration by, or union with, the sexual organ of another or the anal or vaginal penetration of another by any other object; however, sexual battery does not include an act done for a bona fide medical purpose.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    Florida law, specifically\u00a0Chapter 800<\/a>\u00a0has different varieties of acts that may be \u201clewd or lascivious\u201d. For example, a \u201clewd or lascivious\u201d act may consist of \u201cmolestation\u201d which is when a person \u201ctouches in a lewd or lascivious manner the breasts, genitals, genital area, or buttocks, or the clothing covering them, of a person less than 16 years of age, or forces or entices a person under 16 years of age to so touch the perpetrator, commits lewd or lascivious molestation.\u201d\u00a0\u00a7 800.04(5), Statutes.\u00a0<\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
