How to get an injunction or restraining order for repeat violence?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Restraining orders (known as injunctions in Florida) for protection against repeat violence are controlled by\u00a0\u00a7\u00a0784.046, Florida Statutes.<\/a><\/p>\n

Under\u00a0\u00a7 784.046, Florida Statutes<\/a>, you may qualify for an injunction or restraining order if you are the victim of \u201crepeat violence\u201d.\u00a0 Florida law defines, \u201crepeat violence\u201d as \u201ctwo incidents of violence or stalking committed by the respondent, one of which must have been within 6 months of the filing of the petition, which are directed against the petitioner or the petitioner\u2019s immediate family member.\u201d\u00a0\u00a7 784.046(b), Florida Statutes.<\/a><\/p>\n

Under Florida law, \u201cviolence\u201d is defined as \u201cany assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, or false imprisonment, or any criminal offense resulting in physical injury or death, by a person against any other person.\u201d \u00a7 784.046(a), Florida Statutes.<\/p>\n

Again, in accordance with Florida law you must prove two separate instances of violence. One act of violence must have occurred within six (6) months of filing the petition.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t
