About Kalish & Jaggars, PLLC

We believe that family law requires undivided attention. Deep Roots in the Miami Legal Community

Practicing law in Miami-Dade County requires more than just knowing the statutes; it requires an understanding of the local legal culture. Our attorneys are familiar with the local judges, opposing counsel, and the specific procedural nuances of the Miami court system. We leverage this local insight to craft strategies that are realistic, effective, and tailored to the tendencies of the local bench.

Guiding You Through the Uncertainty

The most difficult part of any legal dispute is the “unknown.” Our priority is to replace anxiety with clarity. We take a transparent approach to client communication, explaining every step of the process so you never feel left in the dark. We recognize that behind every case file is a family in transition, and we strive to provide a compassionate environment where you can make informed decisions about your future with confidence.

Strategic Resource Management

Successful outcomes in family law often require a team approach. We collaborate with forensic accountants, child psychologists, and real estate appraisers to ensure every aspect of your case is substantiated by facts. By meticulously preparing for trial while simultaneously pursuing amicable settlements, we position our clients for favorable resolutions, whether at the negotiation table or in the courtroom.

FAQs about Family Law in Miami

How is equitable distribution handled in high-asset Miami divorces?

In Florida, marital assets are divided equitably, which means fairly, though not always equally. In Miami, where high-asset divorces frequently involve complex executive compensation packages, international real estate, or business valuations, accurate appraisal is critical. We work to ensure all assets are properly identified and valued to secure a fair distribution for our clients.

Can I relocate with my child if I move out of Miami-Dade County?

Relocation is a common issue for families in this area. Under Florida law, if you intend to move more than 50 miles away from your current residence for a period of 60 days or more, you must follow strict statutory procedures. You generally need either the written consent of the other parent or a court order granting permission to relocate.

How is alimony determined in Miami courts?

Recent changes to Florida statutes have altered how alimony is calculated and awarded. Courts in Miami look at the length of the marriage and the disparity in income between spouses to determine the necessity and duration of support. There are specific guidelines regarding the duration of payments, and permanent alimony is now largely prohibited except in exceptional circumstances.

Do I have to go to court for a divorce in Miami?

Not every case requires a trial. Many couples in Miami-Dade County resolve their disputes through mediation or collaborative law, which allows for more privacy and control over the outcome. However, if an agreement cannot be reached, we are fully prepared to advocate for your interests before a judge at the Lawson E. Thomas Courthouse Center.
